iPod Touch Skipping Songs During Playback

i've been having problems 2nd gen ipod touch skipping first or second song on playlist ever since upgraded ios 4.2.1. when choose first song, shows @ end of song , goes on next one. i've heard problem 4.2.1 , has been fixed in newer versions. problem 2nd gen ipod touches can't upgraded past version! has else experienced or know how fix it?
 

it possible of songs set "remember playback position", or have manual start / stop times enabled. can check these settings in itunes selecting 1 or multiple tracks , viewing..

info > options > viewing check boxes in window.
